NutrAI Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the NutrAI mobile application (the "App"). NutrAI ("we," "us," or "our") is independently developed and operated by an individual developer, with no separate registered company. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your country) to use NutrAI. By using the App, you represent that you meet this requirement.

2. Description of Service

NutrAI lets you:

• Photograph meals and receive AI-estimated food identification, portions, and macro/calorie breakdowns
• Chat with an AI nutrition assistant
• Browse and follow diet plans
• Log daily meals and track nutrition trends over time
• Manage a profile and daily calorie goal

The App is provided for general wellness and informational purposes only.

3. Accounts

• You may sign in using email one-time-code verification, Google Sign-In, or Sign in with Apple.
• You are responsible for keeping your sign-in method and device secure, and for all activity under your account.
• You must provide accurate information when creating or updating your profile.
• You may delete your account at any time (see our Privacy Policy, Section 8).

4. AI-Generated Content & Health Disclaimer

NutrAI's food recognition and calorie/macro estimates are generated by artificial intelligence and are approximations, not exact measurements. Accuracy depends on photo quality, portion visibility, and inherent limitations of AI image analysis.

• NutrAI is not a medical device, and its output does not constitute medical, nutritional, or dietary advice.
• The App is not intended to diagnose, treat, cure, or prevent any disease or health condition, and is not a substitute for professional advice from a physician, registered dietitian, or other qualified healthcare provider.
• Always consult a qualified professional before making significant changes to your diet, especially if you have a medical condition, allergy, or are pregnant or nursing.
• You use all AI-generated content, diet plans, and nutrition estimates at your own risk.

5. Subscriptions, Credits & Billing

5.1 Tiers

NutrAI offers a free tier ("Explorer") and paid tiers ("Member" and "Pro") that unlock additional AI scans, chat usage, or features, described in the App at the time of purchase.

5.2 Payment & Auto-Renewal

• Paid subscriptions are billed through the Apple App Store or Google Play Store and managed via RevenueCat.
• Subscriptions automatically renew at the end of each billing period (e.g., monthly or annually) at the price shown in the App at the time of purchase, unless cancelled at least 24 hours before the end of the current period.
• Your payment method will be charged for renewal within 24 hours prior to the end of the current period, through the account you used to purchase (Apple ID or Google account).

5.3 Managing & Cancelling

You can manage or cancel your subscription at any time through your device's App Store/Play Store account settings. Cancelling stops future renewals but does not refund the current billing period.

5.4 Refunds

All payments are processed by Apple or Google. Refund requests are subject to Apple's or Google's respective refund policies — NutrAI does not directly process refunds.

5.5 Price Changes

We may change subscription pricing for future billing periods. We will provide notice as required by applicable law and the relevant app store.

6. User Content

• "User Content" means photos, messages, profile information, and any other content you submit through the App.
• You retain ownership of your User Content. By submitting it, you grant NutrAI a limited, worldwide, non-exclusive license to use, store, and process it (including via third-party AI providers, see our Privacy Policy) solely to operate and improve the App.
• You are responsible for ensuring you have the right to submit any content you upload, and that it does not violate any law or third-party right.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or to violate any applicable law
• Upload content that is abusive, obscene, infringing, or that depicts a person without their consent
• Attempt to reverse-engineer, decompile, or interfere with the App or its AI systems
• Use automated means (bots, scrapers) to access the App
• Circumvent subscription/credit limits or any usage restriction

We may suspend or terminate accounts that violate these Terms.

8. Intellectual Property

The App, including its design, code, trademarks, and content (excluding your User Content), is owned by NutrAI or its licensors and protected by intellectual property laws. You are granted a limited, non-transferable, revocable license to use the App for personal, non-commercial purposes.

9. Third-Party Services

The App relies on third-party services, including Supabase, Anthropic, Firebase (Google), RevenueCat, Google Sign-In, and Sign in with Apple. Your use of the App is also subject to the applicable terms of the Apple App Store or Google Play Store through which you downloaded it.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED NUTRITION ESTIMATES WILL BE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUTRAI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH OUTCOMES, OR PROFITS, ARISING FROM YOUR USE OF THE APP OR RELIANCE ON AI-GENERATED CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR USD $50 IF YOU HAVE NOT MADE ANY PAYMENT.

Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability) will survive.

13. Governing Law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of Vietnam, unless otherwise required by applicable consumer protection law in your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in the App or by email before taking effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
